Datenschutzerklärung ADA-APP

Präambel

  1. Diese Datenschutzerklärung beschreibt, wie die ADA Power Woman GmbH („ADA“, „wir“, „uns“), FN 553790y, Vinzenzgasse 30/9, 1180 Wien, die im Rahmen der Verwendung der ADA-App von Ihnen erhobenen personenbezogenen Daten verarbeitet.
  2. ADA behandelt Ihre Daten vertraulich und geht verantwortungsvoll damit um. Wir beachten die anwendbaren Rechtsvorschriften zum Schutz, rechtmäßigen Umgang und zur Geheimhaltung personenbezogener Daten, sowie zur Datensicherheit, insbesondere die Datenschutzgrundverordnung (DSGVO), das österreichische Datenschutzgesetz (DSG) sowie das Telekommunikationsgesetz (TKG).
  3. Als personenbezogene Daten gelten alle Informationen, die sich auf eine identifizierte oder identifizierbare Person beziehen. Darunter fällt etwa Ihr Name oder Ihre E-Mail-Adresse.

Verwendung der App – Vertragserfüllung

  1. Für die Geschäftsanbahnung und Geschäftsabwicklung betreffend der in der App angebotenen Leistungen verarbeiten wir folgende Daten:
    1. Name
    2. E-Mail-Adresse
    3. Daten über Ihr Nutzungsverhalten (z. B. konsumierte Inhalte)
  2. Die Verarbeitung der angegebenen Daten erfolgt zur Erfüllung des Vertrags mit Ihnen (Art. 6 Abs. 1 lit. b DSGVO) – ohne Nutzung dieser Daten können wir die von Ihnen ausgewählten Leistungen nicht erbringen.
  3. Die personenbezogenen Daten werden bis zur Löschung Ihres Accounts gespeichert.

Weitere Verarbeitungszwecke

  1. Für die Verbesserung der ADA-App verarbeiten wir folgende Daten:
    1. Informationen über Nutzerverhalten in der App (z. B. Anzahl der Besuche, Dauer des Besuchs und Pfad des Users während Besuchs inkl. Klicks)
    2. Informationen über Abstürze der App
  2. Die Verarbeitung der angegebenen Daten erfolgt ausschließlich auf Basis Ihrer freiwilligen Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
  3. Die personenbezogenen Daten werden für diesen Zweck nur bis zu einem etwaigen Widerruf der Einwilligung oder bis zur Löschung des Accounts verarbeitet.
  4. ADA Power Woman benötigt die Kontaktinformationen, die Sie uns zur Verfügung stellen, um Sie bezüglich unserer Produkte und Dienstleistungen zu kontaktieren. Sie können sich jederzeit von diesen Benachrichtigungen abmelden.

Übermittlung Ihrer personenbezogenen Daten

  1. Wir überlassen Ihre personenbezogenen Daten im erforderlichen Umfang folgenden externen Dienstleistern (Auftragsverarbeiter), die uns bei der Erbringung unserer Dienste unterstützen. Alle unsere Auftragsverarbeiter verarbeiten Ihre Daten nur in unserem Auftrag und auf Grundlage unserer Weisungen, damit wir Ihnen unsere Dienste zur Verfügung stellen können. Dabei handelt es sich um folgende Dienstleister:
    1. IT-Dienstleister und/oder Anbieter von Datenhosting-Lösungen oder ähnlichen Diensten; sowie
    2. andere Dienstleistungsanbieter, Anbieter von Tools und Softwarelösungen, die uns ebenfalls bei der Erbringung unserer Dienste unterstützen und in unserem Namen tätig sind (einschließlich Anbieter von Marketingtools, Anbieter von Kommunikationsdiensten).
  2. Darüber hinaus übermitteln wir Ihre personenbezogenen Daten im erforderlichen Umfang an die folgenden Empfänger (Verantwortliche):
    1. Rechtsvertreter im Anlassfall sowie Gerichte (unsere berechtigten Interessen)
    2. Wirtschaftstreuhänder, Behörden, Gerichte und andere öffentliche Stellen im gesetzlich erforderlichen Ausmaß (z. B. Finanz- oder Datenschutzbehörde)
  3. Die Übermittlung der personenbezogenen Daten erfolgt nur dann an Empfänger in Drittländern außerhalb des EWR-Raums, sofern für diese Länder ein Angemessenheitsbeschluss der Europäischen Kommission vorliegt, wir durch Abschluss eines rechtsverbindlichen Dokuments geeignete Garantien für den Schutz personenbezogener Daten vorgesehen haben oder Sie für Einzelfälle explizit Ihre Einwilligung i. S. d. Art. 49 Abs. 1 lit. a DSGVO erteilt haben.

Ihre Betroffenenrechte

  1. Sie haben das Recht Informationen auf klare, transparente und leicht verständliche Art und Weise darüber zu erhalten, wie wir die personenbezogenen Daten verarbeiten sowie über Ihre Rechte als Betroffener (Art. 12 ff DSGVO):
  2. Sie haben daher ein Recht auf Auskunft über die von uns über Sie verarbeiteten personenbezogenen Daten. Zusätzlich haben Sie das Recht auf Berichtigung unrichtiger Daten und Löschung Ihrer personenbezogenen Daten (Recht auf Vergessenwerden). Sie können darüber hinaus etwaige erteilte Einwilligungen ohne Angabe von Gründen jederzeit mit Wirkung für die Zukunft widerrufen. Ihnen steht weiterhin ein Recht auf Einschränkung der Verarbeitung, auf Herausgabe der von Ihnen bereitgestellten Daten in einem strukturierten, gängigen und maschinenlesbaren Format (Datenübertragbarkeit) und das Recht auf Widerspruch zu.

Data Protection Notice ADA-APP

Preamble

  1. This data protection notice describes how ADA Power Woman GmbH („ADA“, „we“, „us“), FN 553790 y, Vinzenzgasse 30/9, 1180 Vienna, processes the personal data collected from you in the course of using the ADA app.
  2. ADA treats your data confidentially and handles it responsibly. We comply with the applicable legal provisions on the protection, lawful handling and confidentiality of personal data, as well as on data security, in particular the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and the Telecommunications Act (TKG).
  3. Personal data is any information that relates to an identified or identifiable person. This includes, for example, your name or your e-mail address.

Use of the app – performance of the contract

  1. We process the following data for the purpose of initiating and executing business transactions relating to the services offered in the app:
    1. Name
    2. E-Mail-Address
    3. Data about your usage behaviour (e.g. content consumed)
  2. The processing of the data provided is carried out in order to fulfil the contract with you (Art 6 para 1 lit b GDPR) – without the use of this data we cannot provide the services you have selected.
  3. The personal data will be stored until your account is deleted.

Other processing purposes

  1. For the improvement of the ADA App we process the following data:
    1. Information about user behaviour in the app (e.g. number of visits, duration of the visit and path of the user during the visit including clicks)
    2. Information about crashes of the app  
  2. The processing of the data provided is exclusively based on your voluntary consent (Art 6 para 1 lit a GDPR).
  3. The personal data will only be processed for this purpose until any revocation of consent or until the account is deleted.
  4. We process the following data for sending e-mail newsletters:
    1. Name
    2. E-Mail-Address
  5. The processing of the data provided takes place exclusively on the basis of your voluntary consent (Art 6 para 1 lit a GDPR in conjunction with Section 174 TKG).
  6. The personal data will be deleted for this purpose after any revocation of consent or after three years of inactivity in the ADA app.
  7. Ada needs the contact information you provide us to contact you regarding our products and services. You can unsubscribe from these notifications at any time.

Transfer of your personal data

  1. We provide your personal data to the extent necessary to the following external service providers (processors) who assist us in providing our services. All our processors process your data only on our behalf and on the basis of our instructions so that we can provide you with our services. They are the following service providers:
    1. IT service providers and/or providers of data hosting solutions or similar services; and
    2. other service providers, tool providers and software solution providers who also assist us in the provision of our services and act on our behalf (including marketing tool providers, communication service providers).
  2. In addition, we transfer your personal data to the following recipients (controllers) to the extent necessary:
    1. Legal representatives in cases of need as well as courts (our legitimate interests)
    2. Auditors, authorities, courts and other public bodies to the extent required by law (e.g. financial or data protection authorities)
  3. Personal data will only be transferred to recipients in third countries outside the EEA area if an adequacy decision has been issued by the European Commission for these countries, we have provided suitable guarantees for the protection of personal data by concluding a legally binding document or you have given your explicit consent pursuant to Art 49 (1) lit a GDPR for individual cases.

Your data subject rights

  1. You have the right to receive information in a clear, transparent and easily understandable way about how we process personal data and about your rights as a data subject (Art 12 ff GDPR).
  2. You have a right to access the personal data we process about you. In addition, you have the right to have incorrect data corrected and your personal data deleted (right to be forgotten). Furthermore, you can revoke any consent you may have given at any time with effect for the future without giving reasons. You also have the right to restrict processing, to receive the data you have provided in a structured, common and machine-readable format (data portability) and the right to object.
